The lawsuit argues that Apple bases starting salaries on employees’ previous job pay or their pay expectations, which tends to result in lower starting salaries for women. Additionally, it claims that Apple’s performance evaluation and raise systems are unfair to women, leading to ongoing pay gaps.

Apple has responded by stating its commitment to fairness and equal pay, noting that it has ensured equal pay for men and women since 2017. However, the lawsuit contends that Apple’s current practices still result in significant pay gaps between male and female employees.

The women are represented by lawyers specializing in class action lawsuits, with Eve Cervantez, one of their lawyers, asserting that Apple’s practices exacerbate gender pay gaps. Since 2018, California law has prohibited employers from asking job applicants about their previous salaries to prevent such pay gaps based on gender and race.
